29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     Jobsite:    Employees were exposed to fall hazards in excess of six feet.    Instance A:  Two employees working on the roof were exposed to a fall hazard of approximately 15 feet or more.    Instance B:   Two second floor window openings were unguarded and exposed employees to a fall hazard of approximately 16 feet.    Modern Homes Construction, Inc. was previously cited for a violation of this occupational safety and health standard ( 29 CFR 1926.501 (b)(13)), which was contained in OSHA inspection number 910126, citation number 1, item number 1 and was affirmed as a final order on September 10, 2013, with respect to a workplace located at 308 Country Club Way in Kingston, MA.

29 CFR 1926.20(b)(3): Machinery, tool(s), material(s), or equipment which was not in compliance with the applicable requirement(s) of 29 CFR 1926 was not prohibited, and/or was not either identified as unsafe by tagging, or locking the controls to render them inoperable, or physically removed from its place of operation.  Jobsite:  An extension cord, which had its outer insulation almost completely cut through in two locations, had not been tagged out as unsafe to use.
