29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: Although the employer developed and implemented a program for the control of hazardous energy used at the facility; it was deficient in that, specific instructions for isolating, blocking, or securing hazardous energy were not developed or utilized by employee tasked with completing service and/or maintenance activities of the company's machinery (i.e.: pasteurizer agitators, various style vats and silos (etc.). Energy sources used at the facility include electric and pneumatic with voltages ranging from 480 volt/3 phase to 110 -120 / single phase.

29 CFR 1910.303(b)(6): Unless identified for use in the operating environment, conductors or equipment were located in damp or wet locations; where exposed to gases, fumes, vapors, liquids, or other agents that had a deteriorating effect on the conductors or equipment; or where exposed to excessive temperatures: On or about April 06, 2017, employees tasked with completing clean-up and/or sanitation of areas such as; but not limited to, the HTST or Reverse Osmosis (RO) room were potentially exposed to electrical hazards created from conductors and panels that were not designed for environment in which they were used. The electrical conductors and panels were not water proof and were extremely rusty due to the corrosive environment they were installed.

29 CFR 1910.303(b)(7)(i): Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings were not effectively closed to afford protection substantially equivalent to the wall of the equipment: On or about April 06, 2017, the employer failed to ensure that a 120/240 volts, 3phase, junction box located next to the stairs in the Reverse Osmosis room was free from damage. The face plate was pulled away from the junction box and thus had the potential to expose employees to electrical hazards from the wiring contained within the unit.
