OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards: (a) In the Auto Body Shop Building: On or about April 27, 2017, and at times prior, the Challenger Lift was not equipped with operable arm restraint devices. The employer allowed employees to use the defective lift, exposing employees to struck-by and crushed-by hazards.

29 CFR 1910.305(g)(1)(iv): Flexible cords and/ or cables were used for purposes prohibited by paragraphs (A) through (F) of 29 CFR 1910.305(g)(1)(iv)(a): (a) In the Auto Body Shop Building: On or about April 27, 2017, and at times prior, an electrical flexible cord was being used as a substitute for fixed wiring to provide electrical power to the Challenger Lift. The flexible cord was attached to metal I-beams and to the lifts structure, exposing employees to an electrical hazard.

29 CFR 1910.305(g)(2)(iii): Flexible cords and cables were not connected to devices and fittings so that strain relief was provided that would prevent pull from being directly transmitted to joints or terminal screws: (a) In the Auto Body Shop Building: On or about April 27, 2017, and at times prior, a flexible electrical cord used to provide electrical power to the Challenger Lift was not provided with a strain relief device to prevent tension from being transmitted to the joints, exposing employees to an electrical hazard.
