29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions.  (a)  On or about April 26, 2017, and at times prior thereto, employees exposed to hazardous conditions were not required to don appropriate personal protective equipment, such as but not limited to use safety glasses while using pneumatic nail guns while performing roofing activities.  Note: Abatement certification IS required for this item.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level were not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a) On or about April 26, 2017, the employer did not ensure employees were protected from fall hazards while performing roofing activities.  Employees were exposed to an approximate 36 foot fall hazard while working on this 4 in 12 pitch structure.   Note) Abatement certification IS required for this item.
