OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by livestock. On or about April 29, 2017, and at times prior thereto, employees working in the kill pens to "push" bulls into the chute were exposed to struck by and impalement hazards. Bulls have changed direction and charged the workers suddenly. The workers have to climb over, under or through fence openings to escape. The employer did not provide effective means for employees to escape from agitated bulls.
