29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: Location: 4th floor, South West building face of 1 Harbor View Bay Tarrytown, NY 10591 On or about: 2/23/17 a) Two employees on the fourth tier of a tubular welded frame scaffold, working near the scaffold platform end, were not protected from falls of approximately 24 feet to the ground. The top guardrail was not installed to protect employees from falling.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: Location: 2nd floor balcony, West face of building, 1 Harbor View Bay Tarrytown, NY 10591 On or about: 2/23/2017 a) an employee was observed on the 3rd floor working near the balcony leading edge, without guardrails. The employee was not protected from falling approximately 20 feet to ground below.
