29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. On or about 5/3/2017, at Deck level #39 of the above addressed worksite, the employer had not protected employees from an electrical hazard as evidenced by, among other conditions; a portable saw (Skil, Model SPT2ZW, Serial #505006592) which lacked a ground prong was energized from a non-functioning ground fault circuit interrupter; equipment found to be defective was not tagged to prevent its use and/or daily inspections of equipment connected by cord and plug were not made prior to usage, etc.
