29 CFR 1910.140(c)(13)(ii): Anchorages were not designed, installed, and used, under the supervision of qualified person, as part of a complete personal fall protection system that maintains a safety factor of at least two: On or about April 25, 2017, employees were exposed to fall hazards when two employees tied off to an air conditioner when working on the air conditioners close to the roof edge. The employer did not ensure a qualified person determined that the air conditioner met the anchorage requirements. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.333(b)(2): While an employee was exposed to contact with parts of fixed electric equipment or circuits which were deenergized, the requirements of paragraph (b) of 29 CFR 1910.333 were not followed in the order in which they are presented therein (i.e., paragraph (b)(2)(i) first, then paragraph (b)(2)(ii), etc.): On or about May 5, 2017, employees were exposed to electrical and struck-by hazards when lockout/tagout was not performed as required per this standard when adjusting, inspecting, maintaining, repairing, cleaning, and servicing air conditioning equipment. Each employee working on a system did not apply his/her own lock nor were there written procedures for performing the work. No abatement certification or documentation is required for this item.
