29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Desco Acquisition LLC, dba Blackeagle Energy Services, at 5452 North Colorado Highway 1, Fort Collins, CO: On and preceding 5/1/17, the employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them). Employees of Blackeagle Energy Services and an employee of Complete Energy Services Inc performed a pigging operation of a newly constructed natural gas pipeline. During the pigging operation, the employee of Complete Energy Services Inc was struck by pressurized water and multiple pigs. Blackeagle Energy Services did not ensure that a competent person performed frequent inspections of the worksite and the pig receiver to ensure that workers would not be struck by pressurized water or pigs. This condition exposed employees of Blackeagle Energy Services and the employee of Complete Energy Services Inc to struck-by hazards.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) Desco Acquisition LLC, dba Blackeagle Energy Services, at 5452 North Colorado Highway 1, Fort Collins, CO: On and preceding 5/1/17, the employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury. Employees of Blackeagle Energy Services and an employee of Complete Energy Services Inc performed a pigging operation of a newly constructed natural gas pipeline. During the pigging operation, the employee of Complete Energy Services Inc was struck by pressurized water and multiple pigs. Blackeagle Energy Services did not train employees, including but not limited to the foreman, on the hazards of pigging operations and control methods to ensure that workers were not exposed to pressurized water or struck-by hazards. This condition exposed employees of Blackeagle Energy Services and the employee of Complete Energy Services Inc to struck-by hazards.

Blackeagle Energy Services did not ensure that a person certified to perform first aid was available at the worksite.
