29 CFR 1926.451(c)(2)(v): Fork-lifts shall be used to support scaffold platforms only when the entire platform is attached to the forks and the fork-lift is not moved horizontally while the platform is occupied. A) James Horning, owner of Horning Construction Ltd. on or about May 3, 2017 conducting work at 2410 Old State Road, Norwalk, Ohio, 44857: The employer did not ensure a 12ft x 4ft working platform, was securely attached to the forks. The unsecured platform was at a height of 12ft when an employee was applying trim material to the roof eaves. B) James Horning, owner of Horning Construction Ltd. on or about May 3, 2017 conducting work at 2410 Old State Road, Norwalk, Ohio, 44857: The employer did not ensure that a pallet used as a working platform, was securely attached to the forks. The unsecured pallet platform was at a height of 10ft when the employee was applying metal siding

29 CFR 1926.451(g)(1): 29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section: A) James Horning owner of Horning Construction conducting work at 2410 Old State Road, Norwalk, Ohio, 44857: On or about May 3, 2017 the employer did not ensure that employees were protected from a fall while working from a Basket scaffold. The employees were exposed to a 12 feet fall to the level below while applying trim to a pole barn. No form of fall protection was in place. B) James Horning, owner of Horning Construction Ltd. on or about May 3, 2017 conducting work at 2410 Old State Road, Norwalk, Ohio, 44857: The employer did not ensure that employees were protected from a fall while working from a pallet scaffold. The employees were exposed to a 12 feet fall to the level below while applying sheeting to a pole barn. No form of fall protection was in place.
