29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) At 1541 West Beach, Gulf Shores, Alabama: On or about May 11, 2017, and at times prior; the employer allowed and observed his employees on site performing framing activities while standing on the top plate as trusses were being lifted to them without fall protection, exposing them to a fall hazard of fifty three (53) feet to the ground below.

29 CFR 1926.1053(b)(13): The top or step of a stepladder was used as a step: a) At 1541 West Beach, Gulf Shores, Alabama: On or about May 11, 2017, and at times prior; the employer allowed his employees to improperly use portable ladders. The top step of an eight foot (8') step ladder was being used on the second floor of the building to preform framing activities; exposing employees of fall hazards of heights up to twenty two feet (22') which include an eight foot (8') fall to the decked service or ground below.
