OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to deflagration, explosion, and fire hazards: b) Hamlet Protein, Inc. located at 5289 Hamlet Drive in Findlay, Ohio; on or about May 17, 2017 the employer failed to provide a workplace free from recognized deflagration, explosion, and fire hazards associated with the use of indoor air material separators to capture airborne soy meal material that becomes airborne during the processing operation. The volative condition was documented at the employers facility on May 17, 2017 to include instances such as, but not limited to the AirLanco Dust Collector located on the HP 100 line downstream of the Reynolds Engineering & Equipment Air Swept Pulverizer, (model 28-H, s/n 0399). In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
