29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) TSM Construction LLC, at Lamborn Ave. between 2nd and 3rd St., Paonia, CO 81428: On and before May 16, 2017, the employer did not ensure that daily inspections of the excavations, adjacent areas, and protective systems were made by a competent person. The employer was replacing water pipe in a trench up to 6 feet deep without ensuring the proper use of protective systems. This condition exposed employees to cave-in hazards.
