29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: Warehouse - On or about 05/16/17 the orange LPG-powered Toyota forklift, S.N. 10355 (13,300 lb.) was defective and unsafe due to the failure of the hydraulic system. The vehicle was not removed from service, and workers intending to operate it were exposed to pressurized hydraulic fluid. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
