29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about May 16, 2017, an employee was exposed to a fall hazard of greater than 6 feet to the ground level below while attaching plywood panels without the use of fall protection equipment.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used: On or about May 16, 2017, employees were exposed to a fall hazard greater than 6 feet to the ground level below, while framing and decking without being trained to recognize the hazards of falls. Martin Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(2)(iii) which was contained in OSHA inspection number 1107929, citation number 1, item number 2b, and was affirmed as a final order on 1/29/2016, with respect to a workplace located at 8222 City Base Landing, San Antonio, TX 78203.
