29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k):  (a) Workplace - The employer failed to provide hearing conservation training to an employee exposed to an 8-hour time-weighted average of  96.3 decibels while performing firearm recertification exercises at the firing range, on or about September 8, 2017.  (b) Workplace - The employer failed to provide hearing conservation training to an employee exposed to an 8-hour time-weighted average of  95.3 decibels while performing firearm recertification exercises at the firing range, on or about September 8, 2017.  (c) Workplace - The employer failed to provide hearing conservation training to an employee exposed to an 8-hour time-weighted average of  97.8 decibels while performing firearm recertification exercises at the firing range, on or about September 8, 2017.  (d) Workplace - The employer failed to provide hearing conservation training to an employee exposed to an 8-hour time-weighted average of  95.8 decibels while performing firearm recertification exercises at the firing range, on or about September 8, 2017.  (e) Workplace - The employer failed to provide hearing conservation training to an employee exposed to an 8-hour time-weighted average of  96.8 decibels while performing firearm recertification exercises at the firing range, on or about September 8, 2017.  (f) Workplace - The employer failed to provide hearing conservation training to an employee exposed to an 8-hour time-weighted average of  95.6 decibels while performing firearm recertification exercises at the firing range, on or about September 8, 2017.  (g) Workplace - The employer failed to provide hearing conservation training to an employee exposed to an 8-hour time-weighted average of  97.2 decibels while performing firearm recertification exercises at the firing range, on or about September 8, 2017.  (h) Workplace - The employer failed to provide hearing conservation training to an employee exposed to an 8-hour time-weighted average of  93.3 decibels while performing firearm recertification exercises at the firing range, on or about September 8, 2017.  (i) Workplace - The employer failed to provide hearing conservation training to an employee exposed to an 8-hour time-weighted average of  96.9 decibels while performing firearm recertification exercises at the firing range, on or about September 8, 2017.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1910.1025(d)(2): An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:  (a) Firing Range - The employer failed to perform initial determination where sampling determined that employees were exposed to 60.7 micrograms of lead while performing firearm recertification exercises, on or about September 8, 2017.  (b) Firing Range - The employer failed to perform initial determination where sampling determined that employees were exposed to 249.7 micrograms of lead while performing firearm recertification exercises, on or about September 8, 2017.  (c) Firing Range - The employer failed to perform initial determination where sampling determined that employees were exposed to 12.54 micrograms of lead while performing firearm recertification exercises, on or about September 8, 2017.  (d) Firing Range - The employer failed to perform initial determination where sampling determined that employees were exposed to 584.4 micrograms of lead while performing firearm recertification exercises, on or about September 8, 2017.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1910.95(l)(1): The employer did not make available to affected employees or their representatives copies of 29 CFR 1910.95 and did not post a copy in the workplace:  (a) Workplace - The agency did not post or provide copies of the noise standard for its employees enrolled in its Hearing Conservation Program that were exposed to hazardous noise levels at 8-hour time-weighted averages ranging from 93.3 - 97.8 decibels, on or about September 8, 2017.                                  No abatement certification or documentation required for this item.
