29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. a) On or about May 19, 2017, two (2) employees installing gutters accessed the 10 feet high, low pitch roof they were walking and standing on using an unsecured portable extension ladder that extended only two (2) feet above the eave of the roof, exposing themselves to a ten (10) feet fall hazard while transitioning from the landing surface and the ladder.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about May 19, 2017, two (2) employees installing gutters around the roof eave while standing on a 4:12 pitch roof were not protected from falling 10 feet to the ground by the use of a guardrail system, safety nest system or personal fall arrest system. TCI Contracting, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 992189, citation number 1, item number 1 and was affirmed as a final order on 12-16-2014, with respect to a workplace located at 9067 Redonda St., Boca Raton, Florida.
