OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards when utilizing unanchored and damaged steel storage racks:    (a)  On or about May 25, 2017, the employer did not ensure that the three level storage rack system with multiple bays used to store pallets of materials weighing 900-1000 lbs., displayed plaques with rated loads (1.4.2 plaque);    (b)  On or about May 25, 2017, the employer did not ensure that the steel storage racks column base plates were anchored to the floors by anchor bolts (1.4.7 column anchorage);    (c) On or about May 25, 2017, the employer did not ensure that the steel storage racks with visible damage were immediately isolated until the damaged portions were evaluated by a storage rack design professional and were not placed back into service until repaired and certification was obtained that the repaired components of the storage rack system were restored to at least their original design capacity (1.4.9 rack damage);    Employees were exposed to struck-by and/or crush-by hazards while working in and around the damaged storage rack system.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
