29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:  a) On or about May 31, 2017, the employer failed to ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems, in that employees working on top of tanker trailers (approximately 10 feet above floor) inside the wash bay did not utilize any of the above methods.  An employee was hospitalized for serious injuries suffered in a fall from the top of a tanker trailer.

29 CFR 1910.134(a)(1): When effective engineering controls were not feasible or while they were being instituted, appropriate respirators were not used pursuant to the requirements of 29 CFR 1910.134:    (a) On or about May 31, 2017, the employer failed to ensure that, when effective engineering controls were not feasible or while they were being instituted, appropriate respirators were not used pursuant to the requirements of 29 CFR 1910.134, in that employees opening the dome lids of tanker trailers previously containing eggs were exposed to respiratory hazards associated with unpredictable levels of hydrogen sulfide (H2S) gas. An employee was hospitalized for serious injuries suffered when he fell from the top of an egg tanker trailer after he opened a dome lid and was overcome by hydrogen sulfide gas.

29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces:  (a) On or about May 31, 2017, the employer failed to evaluate the workplace to determine if any spaces were permit-required confined spaces, in that, employees were required to work at the plane, and break the plane of, tanker trailers identified as confined spaces and having the potential for hazardous atmospheres including hydrogen sulfide gas. A system for evaluation of confined spaces, as well as a permitting and labeling system was not in place at the time of the inspection. Employees were exposed to serious hazards associated with toxic atmospheres.
