29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    a. Saw Side of Glacier Stone Supply, LLC: On or about June 7, 2017, and at times prior, employees were exposed to respiratory hazards without the employer having implemented an effective respiratory protection program in place while employees were performing operations including, but not limited to, rock sawing, rock breaking and dry cleaning operations.     b. Saw Side of Glacier Stone Supply, LLC: On or about June 7, 2017, and at times prior, employees were exposed to respiratory hazards without having been given medical evaluations prior to being required to wear respirators while employees were performing operations including, but not limited to, rock sawing, rock breaking and dry cleaning operations.     c. Saw Side of Glacier Stone Supply, LLC: On or about June 7, 2017, and at times prior, employees were exposed to respiratory hazards without having been thoroughly trained on the potential respiratory hazards that could be encountered during daily operation while employees were performing operations including, but not limited to, rock sawing, rock breaking and dry cleaning operations.     d. Saw Side of Glacier Stone Supply, LLC: On or about June 7, 2017, and at times prior, employees were exposed to respiratory hazards without having been thoroughly trained on the proper use of respirators while performing operations including, but not limited to, rock sawing, rock breaking and dry cleaning operations.

29 CFR 1910.1000(c): Employees were exposed to respirable silica in excess of the 8-hour time weighted average limits of 0.3125 mg/m^3 listed in Table Z-3:       a. On or about June 7, 2017, and at times prior, an employee was engaged in Rock Breaking activities while working at the Chris Cutter 10 and was overexposed to respirable silica dust at a concentration of 3.08 mg/m3 expressed as an 8-hour time weighted average of approximately 1.93 times the daily Permissible Exposure Limit (PEL) of 1.59 mg/m3 based on a 475 minute sampling period; exposure calculations included a zero-increment for the 5 minutes not sampled.     b. On or about June 7, 2017, and at times prior, an employee was engaged in Rock Breaking activities while working at the Chris Cutter 8 and was overexposed to respirable silica dust at a concentration of 1.45 mg/m3 expressed as an 8-hour time weighted average of approximately 2.52 times the daily Permissible Exposure Limit (PEL) of 0.59 mg/m3 based on a 475 minute sampling period; exposure calculations included a zero-increment for the 5 minutes not sampled.     c. On or about June 7, 2017, and at times prior, an employee was engaged in loading and sorting activities behind the Chris Cutter 7 and was overexposed to respirable silica dust at a concentration of 0.79 mg/m3 expressed as an 8-hour time weighted average of approximately 1.64 times the daily Permissible Exposure Limit (PEL) of 0.48 mg/m3 based on a 475 minute sampling period; exposure calculations included a zero-increment for the 5 minutes not sampled.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a. Splitter Side Glacier Stone Supply, LLC: On or about June 7, 2017, and at times prior, employees were exposed to hazards associated with the lack of knowledge of proper care and maintenance and limitations of respirators while using Jackson Safety filtering face pieces during splitting operations.
