29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.  a.  At the work site, employees who moved materials for processing used a fork lift truck with a defective horn.  The employer did not ensure that the fork lift truck was taken out of service until the horn was repaired.

29 CFR 1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with this section. The written program shall be available for inspection by employees and their authorized representatives.  a.  On or about June 14, 2017, employees who processed materials entered up to nine confined spaces in the processing equipment during maintenance, cleaning and repairs.  The employer's program did not identify the location of each confined space.
