29 CFR 1926.416(a)(3): Employer did not post or maintain proper warning signs at locations where the performance of the work could bring a person, tool, or machine into physical or electrical contact with an energized electrical power circuit: 50 Cedar Street, Somerville, MA On or about June 12, 2014, the employer failed post proper warning signs of 13.8kV primary and 240v secondary overhead energized power lines where a PC490 excavator was operating under the lines to excavate soil, drill and blast, and load dump trucks.

29 CFR 1926.651(j)(1): Adequate protection shall be provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face. Such protection shall consist of scaling to remove loose material; installation of protective barricades at intervals as necessary on the face to stop and contain falling material; or other means that provide equivalent protection. 50 Cedar Street, Somerville, MA 02143 On or about June 12, 2017, employees were exposed to loose soil while performing pipe work in a trench 15 feet in depth where the protective system did not extend to the employees' work area. On or about June 12, 2017, an employee was struck by a piece of soil (clay) while in the trench and sustained a serious back injury requiring a response and rescue by the Somerville Fire Department.

29 CFR 1926.600(a)(6): All equipment covered by this subpart did not comply with the requirements of 1926.550(a)(15) when working or being moved in the vicinity of power lines or energized transmitters: 50 Cedar Street, Somerville, MA On or about June 12, 2014, employees were exposed to electrical shocks from energized connectors and/or uninsulated energized overhead wires while excavating earthen material from a trench with an excavator to a depth of approximately 15 feet and loading the excavated materials over the sides and into 10-foot high dump trucks. The P. Gioioso & sons, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.600(a)(6): , which was contained in OSHA inspection number 315556936 citation number 03, item number 002 and was affirmed as a final order on 12/07/2012, with respect to a workplace located at Grant St. and C St., Framingham, MA.
