OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to rack collapse hazards and overhead struck-by hazards from bent racking and the material stored on them in the following but not limited to area; Location: Building #35 On or about 6/23/17, employees were exposed to rack collapse hazards and overhead struck by hazards, due to racking upright section M702600B001 and PK90038 being out of plumb by approximately 1-inch. Abatement language amended to: Among other methods, feasible and acceptable abatement methods to correct this hazardous condition would include the following elements...(see original citation language) 5a1 abatement element 1 amended to: 1. Inspect and remove all damaged storage racks from service in accordance with ANSI MH16.1:2008, Specification for the Design, Testing, and Utilization of Industrial Steel Storage Racks, Section 1.4.11.1 (out-of-plumb limit) and Section 1.4.11.2 (out-of-straight limit).

29 CFR 1910.37(a)(4): Safeguard(s) designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times: Location: Building #35, Rack #2062 On or about 6/23/17, the employer exposed employees to life safety hazards due to not maintaining the minimum 18-inches of clearance between the automatic sprinkler system and the pallet of syringes stored in the warehouse racking below.
