29 CFR 1926.300(a): Condition of tools. All hand and power tools and similar equipment, whether furnished by the employer or the employee, shall be maintained in a safe condition. a. On or about May 24, 2017, on the roof of a school located at 1701 Cty Rd CE Kaukauna, WI 54130, the employer did not maintain the vacuum tool in a safe condition. An employee was injured when his arm was caught-in the vacuum hose being used without the wheeled rock scoop to remove the rock covering the rubber membrane being replaced.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a. On or about May 24, 2017, the employer did not report within twenty-four hours the in-patient hospitalization of an employee who injured their arm at a job site located at 1701 Cty Rd CE Kaukauna, WI 54130. The injury resulted from the employee's arm being caught in a vacuum hose used to remove rocks from the roof of a school and required surgery to restore blood flow in his arm.
