29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: The employer is failing to protect employees from fall hazards associated with performing residential construction activity while exposed to falls 6 feet or greater. The most recent occurrence of this was observed on June 26, 2017 at the new home being built at 7952 N. 160th St. Bennington, NE where the employer has a crew of 6 employees framing a new home and employees working to frame the second floor walls are standing on the exposed edge without any form of fall protection system. BD Nienhueser Framing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1043983, citation number 1, item number 1 and was affirmed as a final order on 6/5/2015, with respect to a workplace located at 6201 O Street, Lincoln, NE 68510.
