OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. The employees were not instructed to recognize the unsafe condition of standing in front of the Power Buggy where it was intended to be dumped and dumping toward personnel. On or about June 17, 2017, a concrete Power Buggy fell into a footer while dumping concrete and pinned an employee against the wall, causing fractures to the left arm and left leg.
