29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied: The employer is failing to protect employees from fall hazards associated with working off of a scaffold platform that is not secured to the forklift used to raise it. The most recent occurrence of this was evident during the inspection of the job site located at 7220 N. 140th Ave Bennington, NE where the employer has employees working off a platform lifted with a forklift without securing the platform as to prevent it from falling off the forks.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented. The employer is failing to protect employees from fall hazards associated with framing operations on a new residential home where the ground to eave is greater than 6 feet and the roof pitch is more than 4:12. The most recent occurrence of this was evident during the inspection of the job site located at 7218 N. 140th Ave Bennington, NE where the employer has employees setting roof trusses without the use of fall protection and as a result an employee was injured in a fall from approximately 11 feet to the ground below. Larry Peterson Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 981206, citation number 1, item number 1 and was affirmed as a final order on 9/10/2014, with respect to a workplace located at 7324 n. 142nd Ave Omaha, NE 68142.
