29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about July 7, 2017, an employee was exposed to fall hazards of approximately nine feet when the employee cleaned wood from a balcony without fall protection.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)  On or about July 7, 2017, employees were exposed to fall hazards when the employees had  not been trained on the following: a. fall protection is required whether a person is working near the edge of a low slope roof or in the center of a low slope roof b. fall protection is required when moving material c. fall protection is required and additional equipment must be procured when there are not enough ropes d. fall protection is required and appropriate equipment must be procured when the ropes are not long enough e. fall protection is required when working at six feet or more above the lower surface  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  On or about July 7, 2017, employees were exposed to fall hazards of approximately 19 feet and greater when employees were working on an apartment roof.  The employees were wearing harnesses but had not attached a rope or lanyard to their harnesses.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
