29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about July 10, 2017:  a) An employee was exposed to fall hazards of approximately 9.1 feet, the employee was not trained by the employer to be able to recognize the fall hazard and to be able to minimize the hazard present   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about July 10, 2017:  a) An employee was exposed to a fall hazard of approximately 9.1 feet while installing block when the employer failed to fully protect the employee by using guardrail systems, safety net system, or personal fall arrest system.    Fermin Lorenzo was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 993457, citation number 1, item number 1 and was affirmed as a final order on 10/16/2014 with respect to a workplace located at 5545 Dooley Way, Shiloh Woods Subdivision Lot #108 Cumming, GA 30040.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
