29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmosphere containing less than 19.5 percent oxygen) or a hazardous atmosphere existed or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazardous substances are stored nearby, the atmospheres in the excavation were not tested before employees entered excavations greater than 4 feet (1.22m) in depth: Excavation Site: On or about July 13, 2017, the employer allowed employees to operate a gas compactor (tamper) inside the excavation without testing the atmosphere. This condition exposed the employees to respiratory hazards in excavation greater that 4-feet.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: Excavation Site: On or about July 13, 2017; three employees were working inside the excavation with no means of access and/or egress. The excavation was approximately 400-feet long, 15-feet wide and 15-feet deep. This condition exposed the employees to cave-in hazards. El Paso Underground Construction was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 672418, citation number 01, item number 001 and was affirmed as a final order on February 19, 2013, with respect to a workplace located at Desert Springs Unit #1, Trans-Mountain & Northwestern Dr., North side of Highway, El Paso, TX 79912.
