29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of the excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about April 23, 2018, employees performing construction work inside an excavation were not protected from excavated material that was not kept at least 2 feet away from the excavation edge. This condition exposed employees to entrapment and cave-in hazards. 29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart. On or about April 23, 2018, employees observed working inside an excavation where the slope performed did not meet the requirements established in accordance with appendix B of this subpart. This condition exposed employees to entrapment and cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about April 23, 2018, employees working in an excavation were not protected from cave-ins by an adequate protective system. This condition exposed employees to excavation cave-in hazards. El Paso Underground Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1257511, citation number 2, item number 2 and was affirmed and received a final disposition on 05/10/2018, with respect to a workplace located at Hunt Development South of 12000 Biddleston Dr., Horizon City, TX 79928. El Paso Underground Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1246364, citation number 2, item number 2, and was affirmed and received a final disposition on 05/10/2018, with respect to a workplace located at Hunt Development behind 13777 Paseo Del Este, Horizon City, TX 79928.
