29 CFR 1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use: Spray Shed: On or about July 13, 2017, and at times prior thereto, employees were exposed to respiratory hazards, while painting vehicle accessories and spraying bed liners without a respiratory program to address key issues such as, but not limited to, training, fit testing, and medical evaluation for employees required to use a respirator.

29 CFR 1910.1200(e)(1): Employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met: Spray Shed: On or about July 13, 2017, and at times prior thereto, employees were exposed to chemical hazards: the employer did not have a written hazard communication program for employees who were required to use products such as, but not limited to, AX-SP-100 bed liner and paints to spray onto vehicles.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: (a) Installation Area, West Side: On or about July 13, 2017, and at times prior thereto, employees were exposed to chemical hazards in the working area where AX SP 100 SIDE and AX SP 100 SIDE B Spray Liner containing chemicals such as 4,4'Methylenediphenyl Diisocyanate, respiratory and skin sensitizers, were over sprayed and accumulated. (b) Employee Restroom: On or about July 13, 2017, and at times prior thereto, employees were exposed to chemical hazards in the working area where AX SP 100 SIDE A and X SP 100 SIDE B Spray Liner containing chemicals such as 4,4'Methylenediphenyl Diisocyanate, respiratory and skin sensitizers, were accumulated.
