OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  On or about July 25, 2017, employees were exposed to struck-by hazards when damaged racks had not been unloaded, repaired or replaced.  Employees drive powered industrial trucks, walk, and work in the area. a. bent support leg at location B020101 (ladders are leaning against the end of the rack) b. bent support leg at location A011001 (ladders are leaning against the end of the rack)  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  On or about July 25, 2017, employees were not using eye/face protection when changing the propane tanks on the powered industrial trucks.  Employees only used gloves as personal protective equipment. 29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l) or insure that the certification included the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:  On or about July 25, 2017, employees were exposed to struck-by hazards when the employer had not maintained the documentation required to insure that only authorized employees were driving the forklifts and other powered industrial trucks at the site.  There was no documentation for employees hired in the last 4-7 months who were authorized employees.  No abatement certification or documentation is required for this item.    The employer was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1014894, citation number 1, item number 3 and was affirmed as a final order on 03/17/2015, with respect to a workplace located at 705 Middle Street, Middletown, CT 06457.
