29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about 07/26/2017, workers using a ladder jack scaffold that was raised approximately 11 feet from ground during a framing operation were not protected from falling. The workers were observed wearing personal fall arrest system but they were not tied off to prevent them falling to the ground.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On 07/26/2017, Carpenters performing framing tasks on top of second floor of a newly built building were not protected from falling. The workers were observed wearing personal fall arrest system, but were not tied off to prevent them from falling to the ground.
