OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Painting yard: On or about July 31, 2017 and at times prior thereto the employer exposed employees to crush-by hazards in that employees were allowed to work and walk near workhorse rails that were not braced together and not bolted to a hard surface.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours. (a) Coating systems Facility: On or about July 31, 2017 and at times prior thereto the employer failed to report in-patient hospitalization of an employee that occurred on July 15, 2017 as a result of a work-related incident within twenty-four (24) hours after the in-patient hospitalization.
