29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:    Location - Painting booths    On or about May 23, 2019, the employer had not performed an evaluation or identification of respiratory hazards for chemical hazards, such as, but not limited to, formaldehyde, TALC, and xylene, during painting processes.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  Location -Painting booths  On or about May 23, 2019, employees who wore half face air purifying respirator, during wet painting process, was not medically evaluated.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  Location - Painting booths  On or about May 23, 2019, employees were provided voluntary use for half face respirators (3M) with Organic Vapor Cartridge and N95 disposable respirators (3M, 8511) for painting processes, but not provided Appendix D advisory information regarding employees' proper usage.
