29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Location: 319 Broadway Brooklyn, NY On or about: August 2 2017   a) Employee was standing on top of a 10 foot wall that was being constructed. He was not wearing any fall protection and no guard rails or safety nets were provided.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  Location: 319 Broadway Brooklyn, NY On or about: August 2 2017   a) Spoil pile was not located 2 feet or more from the excavation and it did not have any retaining devices to prevent material from falling into excavation. Employees were performing concrete work directly underneath the spoil pile.
