29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a forklift on the jobsite: At the residential construction site located at Lot 114 on SW Blackstone Place, Lees Summit, Missouri: Employees were exposed to caught-in, struck-by, and crushing hazards. The employees had not been formally trained on how to operate a forklift. The employees were working from a platform approximately 11 feet from the ground attached to the forks of the forklift.

29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied At the residential construction site located at Lot 114 on SW Blackstone Place, Lees Summit, Missouri: Employees were exposed to fall and struck-by hazards. The forklift was being used to support a platform being used as a scaffold without the use of a fall arrest system. The platform was attached to the fork of the forklift and was moving horizontally while the platform was occupied. The fall hazard was greater than 11 feet from the platform.
