Main warehouse; On or about August 3, 2017, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. An employee operating a forklift struck a post while traveling. The employee was not restrained by a seat belt, and was subsequently injured. Abatement certification is required of this item in accordance with the requirement of 29 CFR 1903.19(c).

29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics was not provided to the operator when the operator was involved in an accident or near-miss incident: a) 14 Aegean Drive, Methuen, MA. Main warehouse; On or about August 4, 2017, the employer did not ensure that refresher training in relevant topics was provided to the operator when the operator was involved in an accident. An employee was allowed to operate a forklift the day following a forklift accident where the same employee was injured while operating a forklift.This employee operated the forklift without receiving retraining. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
