29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  On or about November 6, 2017, the employer failed to submit certification and supporting documentation that all issued citations were abated timely.  To date, nothing has been received by the employer. Citations were issued as final on September 1, 2017 and became final on October 10, 2017.

29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions:  On or about August 9, 2017, the employer failed to ensure that employees who were working on the ground were wearing hard hats when they were exposed to struck-by hazards from roofing debris that was being thrown off of a 30-35 foot high apartment complex roof during the removal and replacement of the roof.

29 CFR 1926.252(a): An enclosed chute of wood, or equivalent material, was not used where materials were dropped more than 20 feet to points lying outside the exterior walls of the building(s):   On or about August 9, 2017, the employer failed to ensure that employees were using an enclosed waste chute when they were disposing of old roofing materials from atop a 30-35 foot flat roof on a residential apartment building.  Employees were replacing the old roof with a new roof and were throwing old pieces of roof and other materials off of the top of the roof and down into a large trash bin below.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  On or about August 9, 2017, the employer failed to inspect the job site to assess potential hazards, correct the hazards and/or determine the need for specific personal protective equipment such as but not limited to the use of hard hats.  Employees were exposed to struck-by hazards from roofing debris being thrown off the top of a 30-35 feet high apartment complex.       The employer was previously cited for a violation of this occupational safety and health standard or it's equivalent standard which was contained in OSHA Inspection #1158842, citation 1, item 1a, which was affirmed as final order on August 25, 2016, with respect to the workplace located at 119 N. Tremont, Kewanee, IL.
