29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.)  While performing roofing operations the employer did not initiate an adequate safety program that would ensure a safe and healthful working environment. In this case the employee/s were exposed to fall hazards in excess of ten (10) feet.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms where the entire platform was not attached to the forklift.  The employer did not ensure that the scaffold platform being held aloft by a rough terrain forklift was attached to the forklift while roofing operations were being performed in the front of the building being constructed. Employees were exposed to a fall hazard in excess of twelve (12) feet.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  The employer did not ensure that the employees performing roofing operations from an aerial lift in the front of the building being constructed were wearing a restraint system. Employees were exposed to being ejected from the lift and a fall hazard of approximately ten (10) feet to the ground.
