29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a)Frontier Builders, LLC., at 5140 S. Greystone, Sioux Falls SD, 57108: On and before August 10, 2017, the exposing employer did not ensure all forklift operators were trained in the operation of powered industrial trucks including the use of the rough terrain forklift prior to its use. This condition exposed the employees to the hazard of improper forklift operation. Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): (a)Frontier Builders, LLC., at 5140 S. Greystone, Sioux Falls SD, 57108: On and prior to August 10, 2017 the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person in that employees were exposed to fall hazards from a 3rd story balcony while installing siding material. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

Greystone, Sioux Falls SD, 57108: On or about and at times prior to August 10, 2017, the employer did not ensure that each employee was protected from falls from heights in that two employees were installing siding on a third floor balcony of a four story apartment complex without fall protection in place. This condition exposed the employees to a fall hazard of approximately 30 feet.
