29 CFR 1910.28(b)(3)(iv): Each employee was not protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used: On or about August 15, 2017, employees working around the dryer leg were exposed to injuries in the event of falling objects due to the lack of toeboards erected on all exposed sides.

29 CFR 1910.272(g)(1)(ii): Prior to bin entry, all mechanical, electrical, hydraulic, and pneumatic equipment which presented a danger to employees inside grain storage structures in the grain handling facility were not disconnected, locked out and tagged, blocked-off, or otherwise prevented from operating by other equally effective means or methods: On or about August 9, 2017, employees working inside of Bin 10 were exposed to entanglement and engulfment hazards due to both the sweep auger and floor auger were in operation. The employer did not ensure the augers were deenergized and locked out prior to employees entering the bin.
