29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. A. J & M Builders LLC worksite located at 4421 Sage St., Monclova, Ohio: On or about August 23, 2017, the employer did not ensure employees were wearing proper eye protection while operating pneumatic nail guns while performing framing activities on the two story residential structure. The employees were exposed to potential flying object hazards while operating the pneumatic fasteners. J & M Builders LLC was previously cited for a violation of this occupational safety and health standard 1926.95(a), which was contained in OSHA inspection number 1136735, citation number 1, item number 1 and was affirmed as a final order on May 17, 2016, with respect to a workplace located at Monclova, Ohio.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. A. J & M Builders LLC worksite located at 4421 Sage St., Monclova, Ohio: On or about August 23, 2017, the employer did not ensure employees were protected from falls while performing framing activities on the two story residential structure. The employees were exposed to a fall distance of approximately 18.00 feet to the level below. J & M Builders LLC was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1136735, citation number 1, item number 2A and was affirmed as a final order on May 17, 2016, with respect to a workplace located at Monclova, Ohio.
