29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a)  Work Site:  325 Whippany Road, Whippany, NJ  Employee(s) were working inside an excavation that was 6 feet, 3 inches to 9 feet, 10 inches in depth and 61 feet wide by 179 feet long with only one ladder as a means of egress giving much more than 25 feet of lateral travel.  A ladder was not provided on the North end of the excavation and an employee was observed climbing out of the excavation on a 9 foot by 2 foot concrete form leaning on the wall of the excavation.  Violation occurred on or about 02/27/2017.

29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  a)  Work Site:  325 Whippany Road, Whippany, NJ.  A daily inspection of the excavation was not made by a competent person. Excavation had visible deficiencies, such as but not limited to, no protective cave-in system and lack of safe egress.  Violation observed on or about 02/27/2017.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):    a) Work Site:  325 Whippany Road, Whippany, NJ.  Laborers working in an excavation were exposed to struck-by and crushing injuries in the up to 9 foot, 10 inch deep excavation which was not adequately sloped or protected by shields or shoring.                                                                   Violation observed on or about 02/27/2017.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:   a) Work Site:  325 Whippany Road, Whippany, NJ.  Employees were exposed to 7 foot fall hazards from the top of the ladder into the excavation as the ladder side rails did not extend at least 3 feet above the ground which was the upper landing surface.                                                                   Violation observed on or about 02/27/2017.  Ultimate Development, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1175607, citation number 1, item number 5a, and was affirmed as a final order on 12/01/2016, with respect to a workplace located at Lot 13, Center Valley, PA.
