29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Location: 2nd floor On or about: 8/23/17 a) Employees, engaged in residential construction, were not provided with fall protection. The employees were exposed to a fall of 8'9". NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19. The Maldonado Group Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 959216, citation number 1, item number 7a and was affirmed as a final order on 6/16/2014, with respect to a workplace located at 115 Winterton Road Bloomingburg, NY 12721.

The stairway, with 9 risers, did not have a handrail. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19. The Maldonado Group Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1052(c)(1)(i), which was contained in OSHA inspection number 1116839, citation number 1, item number 2 and was affirmed as a final order on 7/12/2016, with respect to a workplace located at. 23 Woodside Place, Monsey, NY 10952.
