OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to vehicles falling from or shifting on automotive lifts: In the following instances employees were exposed to the hazards of falling and shifting vehicles: a) Garage - Automotive lifts were not safely operated and vehicles were not properly supported, balanced or mounted; b) Garage - The Rotary Auto Lift failed the annual inspection and the locking mechanism was malfunctioning; c) Garage - The alignment rack/lift failed the annual inspection and the structural integrity of the welds was deficient.
