29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.   While performing stucco operations the employer did not initiate an adequate safety program that would ensure a safe and healthful working environment. In this case the employees were exposed to a fall hazard of up to fourteen (14) feet from the working surface to the ground below as well as a struck-by hazard due to a lack of head protection for the ground crew.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  The employer did not ensure that ground crew employees who were providing support for stucco operations wore head protection. Employees were exposed to the hazard of being struck-by falling materials and/or equipment.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  The employer did not ensure that the working surface was completely planked on the second level of the scaffold located at the rear of the building. Two aluminum planks were installed where three were required to fully plank the working surface. Employees were exposed to a fall hazard of approximately fourteen (14) feet to the ground below.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  The employer did not ensure that railings were installed on the entire second level of the scaffold located at the rear of the building. Employees were exposed to a fall hazard of approximately fourteen (14) feet to the ground below.
