An emergency response plan shall be developed and implemented to handle anticipated emergencies prior to the commencement of emergency response operations. The plan shall be in writing and available for inspection and copying by employees, their representatives and OSHA personnel. Employers who will evacuate their employees from the danger area when an emergency occurs, and who do not permit any of their employees to assist in handling the emergency, are exempt from the requirements of this paragraph if they provide an emergency action plan in accordance with 29 CFR 1910.38.    The Employer did not provide an adequate emergency response plan for it's employees who may have to deal with the accidental release of hazardous substances being received in the recycle receiving area.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about August 29, 2017 at 1341 W Spencer Street in Appleton, the employer did not provide the Hazmat employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignments.  Employees were not trained on the hazards of the chemicals they worked with nor where they trained on the availability or location of safety data sheets (SDS).  All provisions of the hazard communication standard's training paragraph 29 CFR 1910.1200(h) must be effectively trained to employees. Key elements include, but are not limited to the following:  1)  The requirement of the hazard communication standard 2)  Any work operations where hazard chemicals are present 3)  Location and availability of the:      -hazard communication program      -list of hazardous chemicals      -SDS collection
