29 CFR 1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded:    (a) New townhome construction located on Lot #61, Front side: On or about 08/29/2017, and at times prior, the employer exposed employees to amputation hazards while using the Generac GP5500 Generator, in that the starter recoil cover was not replaced and moving rotating parts were not guarded when employees started, plugged in or turned off the equipment.

29 CFR 1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection:    (a) New townhome construction located on Lot #61, Second floor top plate: On or about 08/29/2017 and at times prior, the employer exposed employees to fall hazards of approximately 20-feet to the lower level while working from an outside top plate, in that adequate personal fall arrest systems were not provided. Anchor points, life-line attachments, lanyards, and body harnesses were not used according to the manufacturer's recommendations and the personal fall protection system requirements under CFR 1926.502(d).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    (a)  New townhome construction located on Lot #61, Top plate: On or about 08/29/2017 and at times prior, the employer exposed employees to fall hazards of approximately 20 feet from the top plate to the lower level, in that a fall protection system was not provided to employees engaged in framing roof trusses.     Faustino Galvan DBA Faustino Galvan Construction, LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 976577, citation number 1, item number 1 and was affirmed as a final order on 06/24/2014, with respect to a workplace located at 155 Humboldt Drive, Fayetteville, GA 30214.
